AGREEMENT OVERVIEW: This Agreement expresses the full and complete agreement between the you (the client) and Lemon Poppy Photography regarding the subject matter hereof. The only way to add or change this agreement is to do so in writing, signed by all parties. Images, Editing and Copyright: Photographs/images produced by Lemon Poppy Photography are protected by Copyright Law (all rights reserved). Upon final payment by the Clients, the Clients are allowed to display resulting images for personal use. Said images may not be altered or reproduced in any manner without prior written permission of Lemon Poppy Photography. The Clients will receive a high resolution USB with printing rights, and may make prints for personal use, but may not copy, or re distribute the USB for commercial use. The Clients must obtain written permission from Lemon Poppy Photography prior to the Clients, their associates, friends or relatives selling the photographs or publishing them commercially (Eg. Newspaper, Magazine) and a licence fee is generally issued. IMAGES and COPYRIGHTS: The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. Images are not to be altered/edited (Instagram filtered) once received in high resolution jpeg format. They have been edited with creative care to suit the style of your session. When posting images on social media, the Clients should tag @lemonpoppyphoto to give credit to the Photographer. Lemon Poppy Photography does not provide any unedited images to the Clients as it does not represent the quality that Lemon Poppy Photography strives for. Lemon Poppy Photography edits each image with exposure correction, shadow and highlight recovery, lens correction and a little artistic flare. Lemon Poppy Photography’s edited images do not include retouched or photoshopped images. This is a service Lemon Poppy Photography does not offer. Lemon Poppy Photography will re-touch a few photos but these are small modifications – for example, fix a large pimple or remove flies from the photograph. RETAINER & PAYMENT SCHEDULE: A non-refundable fee of $75 is due at the signing of this agreement. This is a NON-REFUNDABLE RETAINER. Should the client not show up to the scheduled appointment, cancel the appointment or otherwise breach this Agreement, the NON-REFUNDABLE RETAINER shall be liquidated for damages to Lemon Poppy Photography. Full payment of session is due five days prior to your session date. LIMIT OF LIABILITY: Limit of liability: In the unlikely event that the photographer(s) are injured, become too ill, or has an emergency that prevents them from photographing the event, Lemon Poppy Photography will make every effort to reschedule another session as soon as possible. With every attempt for a weekend session, Lemon Poppy may have to reschedule your session on a week day if weekends are fully booked. Lemon Poppy Photography takes the upmost care with respect to exposure, storage, and processing of the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond Lemon Poppy Photography’s control. Personal liability: It is the client’s responsibility to take care of themselves and their children; Lemon Poppy Photography will not accept any responsibility due to any accident to children or damage to any persons, public or private properties during the photo shooting or consultation session. If the client is choosing to go ahead with the session during the COVID19 pandemic, Lemon Poppy Photography will take the appropriate measures as outlined by the Queensland Government (as listed in COVID19 email communication to the client) however cannot be held liable if any persons from the family contracts COVID19. The client also agrees to follow the rules and regulations as measured in email correspondence and current updates from the Queensland Government. COMPLETION SCHEDULE/DELIVERY OF IMAGES: Completion schedule: Images are expected to be edited within 3-4 weeks after the event date. USB delivery is expected within 5-6 weeks via Australia Post mail. Digital Files: Upon receipt of the digital photos, the client accepts all responsibility for archiving and protecting the photographs. Photographer does not permanently archive image files. All digital image sizes are approximate and will be given to client at eight by twelve inches, three hundred dpi. Any images printed by the client over the provided size may lose image quality. Digital images provided in private online gallery will be in JPG format. Capture, Delivery, Post Production & Editing: The Photographer is not liable to deliver every image taken at the session. The determination of images delivered to the Clients is left to the discretion of the Photographer. The final post-production and editing styles, effects, and overall look of the images are left to the discretion of the Photographer based on her style and the available lighting. Storage and backups: Lemon Poppy Photography keeps client files for up to 12 months after the photography session, and is not liable for any claims after this period. All client files will be deleted and backups will be removed after this period. We strongly recommend that you make two copies of your images - one on your computer (or cloud storage system such as Dropbox) and one on an external hard drive (I even recommend copying to two external hard drives just to be more cautious). By signing your name, date and time and also paying your session fee, you agree to the terms and conditions as outlined in this agreement.

Lemon Poppy Photography spends a lot of time and energy (sometimes days on end) location scouting for our clients and their lifestyle sessions. A lot of this time finding these unique locations is done in-between shooting sessions, editing and responding to client enquiries. At times, we use private property and this under NO circumstances, ever allowed to be given out or supplied to a third party (as stated by the property owners). A location also makes a photography business unique and this is the reason why we put so much energy and time into finding the right locations - this is also probably why you chose Lemon Poppy as well. By engaging in a photography session with Lemon Poppy Photography, you agree to not disclose the suburb, address or general location to any other parties under any circumstances. Should another photographer or client contact you, please refer them to Lemon Poppy Photography and they can ask us for the location directly - should we wish to provide them with this information.
